ABSTRAK

Kejahatan merupakan suatu fenomena kompleks yang dapat dipahami dari segi yang berbeda. Itu sebabnya dalam keseharian kita dapat menangkap berbagai komentar tentang suatu peristiwa kejahatan yang berbeda satu dengan yang lain. Dalam pengalaman kita ternyata tak mudah untuk memahami kejahatan itu sendiri. Oleh karena itu perlu ada bantuan agar hak pelaku tindak pidana terpenuhi. Setiap tahun banyak terjadi pencurian Indonesia diajukan ke pengadilan atas kejahatan ringan seperti pencurian Namun dalam perkembanganya banyak permasalahan mengenai perlindungan hak asasi manusia (HAM) bagi pelaku tindak pidana dalam proses penyidikan dalam penelitian ini permasalahan yang dibahas adalah perlindungan hak asasi manusia (HAM) bagi pelaku tindak pidana dalam proses penyidikan (studi kasus penyidikan tindak pidana pencurian di polres kota pekalongan)

Dari perumusan masalah mengenai perlindungan hak asasi manusia (HAM) bagi pelaku tindak pidana dalam proses penyidikan (studi kasus penyidikan tindak pidana pencurian di polres kota pekalongan) yang tersebut dilakukan penelitian dengan metode pendekatan yuridis Sosiologis yakni penelitian hukum yang menggunakan data sekunder sebagai data awalnya, yang kemudian dilanjutkan dengan data primer atau data lapangan, Meneliti efektivitas suatu Undang-Undang dan Penelitian yang ingin mencari hubungan (korelasi) antara berbagai gejala atau variabel sebagai alat pengumpul datanya terdiri dari studi dokumen, pengamatan (observasi), dan wawancara (interview).

Setelah dilakukan penelitian tentang perlindungan hak asasi manusia (HAM) bagi pelaku tindak pidana dalam proses penyidikan (studi kasus penyidikan tindak pidana pencurian di polres kota pekalongan). di dapat sebuah kesimpulan yaitu Bentuk Perlindungan HAM Terhadap Pelaku Tindak Pidana Pencurian dalam Proses Penyidikan di Polres Kota Pekalongan terdapat dalam pasal 50 sampai pasal 63 KUHAP)., dan Hambatan dalam memberikan Perlindungan HAM Terhadap Pelaku Tindak Pidana Pencurian dalam Proses Penyidikan adalah karena tersangka enggan bekerja sama dengan polisi sehingga mempersulit tindakan penyidikan karena hampir 99% hakim lebih mempercayai BAP yang dibuat oleh polisi..
