ABSTRAK
Dalam sebuah persalinan terdapat dua macam persalinan yaitu,
persalinan secara normal (alamiah) dan persalinan yang dilakukan dengan
tindakan medis (operasi caesar). Persalinan yang dilakukan dengan tindakan
medik ini dilakukan dalam situasi dan kondisi dimana sang ibu tidak mungkin
melakukan persalinan secara alamiah, dalam artian ada indikasi medik untuk
dilakukannya operasi caesar. Seperti panggul ibu terlalu kecil, adanya kelainan
pada mulut rahim, kehamilan kembar, posisi bayi yang tidak normal, bayi dalam
keadaan stress, ibu dengan penyakit serius, lambatnya proses persalinan, ibu yang
memiliki luka herpes, telah pernah melakukan operasi caesar sebelumnya, serta
kecelakaan yang tidak diinginkan. Di Rumah Sakit Umum Daearah Kabupten
Batang menawarkan metode operasi caesar dengan prosedur yang harus
dilakukan pihak pasien yakni dengan memberikan persetujuan tindakan medis
(informed consent).
Penelitian ini termasuk penelitian yuridis empiris dimana penulis
mencoba mendiskripsikan dan mengambarkan bagaimana pelaksanaan informed
consent terhadap pasien operasi caesar dan bagaimana perlindungan hukumnya
terhadap pasien operasi caesar dalam persetujuan tindakan medis (informed
consent) bila terjadi kelalaian yang dilakukan dokter di Rumah Sakit Umum
Daerah Kabupten Batang.
Hasil dari penelitian ini meliputi pemberian informasi kepada pihak
pasien atau keluarganya yang dilakukan dokter, dokter menjelaskan tindakan
medis yang akan dilakukan beserta isi dari informed consent. Penandatanganan
formulir informed consent dan pelaksanaan tindakan medis. Bentuk perlindungan
hukum yang diberikan pihak Rumah Sakit Umum Daerah Kabupaten Batang
terhadap pasien operasi caesar ada 2 ( dua ) yaitu Perlindungan Hukum Preventif
yakni pihak rumah sakit menjamin dokter melakukan tindakan medis sesuai
dengan SOP (Standar Operasional Prosedur)agar tidak menimbulkan kesalahan
tindakan medis dalam menangani pasien. Perlindungan Hukum Reprensif yang
bertujuan menyelesaikan sengketa melalui fasilitas mediasi dan apabila dalam
penyelesaian oleh pihak Rumah Sakit tidak ditemukan jalan damai, maka pihak
pasien dapat melaporkan sengketa tersebut ke MKDKI (Majelis Disiplin
Kedokteran Indonesia).

ABSTRACT
In a labor there are two kinds of labor are normally ( natural ) and
labor performed by the medical action (caesarea section). Labor performed by a
medical act is done in circumstances where the mother may not be doing labor
naturally, in the sense that there are medical indications for caesarea section done,
such as mother’s pelvis is too small, abnormalities in the cervix, multiple
pregnancy, abnormal position of the baby, the baby is under stress, the mother
with a serious illness, the slow process of childbirth, mother who have herpes
sores, had never done before caesarea section, as well as unwanted accidents. In
district general hospital rod affers a method of caesarea section with the
procedures to be carried out by the patient by providing medical consent
( informed consent ).
This research includes empirical juridical where the author tries
to describe and portray how the implementation of informed consent to patients of
cesarea section and how the legal protection of patient consent section in case of
medical negligence by physicians doctor in a public hospital district rod.
The results of this study include the provision of information to
the patient or family doctors do, doctor explaining medical prosedures will be
conducted along with the contents of informed consent. Signing the form informed
consent and implementation of medical measures. Forms of legal protection given
district general hospital to patients caesarea rod is two ( 2 ) fold preventive legal
protection ensure that the hospital doctors perform a medical procedure in
accordance with SOP (Standard Operating Procedures)so as not to cause
misconduct in handling the patient’s medical. Reprensif legal protection aimed
resolve disputes through mediation and arbitraion fcilities and if the settlement by
the hospital did not find the way of peace, then the patient can report the dispute
to the panel of medical discipline assemblies indonesia.
