ABSTRAK
Permasalahansosial di tengah-tengahmasyarakatselalumengalamiperubahandanakanterusberkembangmengikutidinamikamasyarakatitusendiri. Salah satuisusosialyang akhir-akhirinimenjadimasalahkhususnyaadalahkebiasaanmengkonsumsiminumankerassecaraberlebihanhinggamenyebabkanhilangnyakontrolpadadirisendiriyang menyebabkanpelanggaranhukumataubahkantindakpidana.Tidakberbeda pula denganwilayahKabupatenBatang, makadariituPemkabBatangmenetapkanPerda No. 12 Tahun 2013 yang mengaturtentangperedarandanpenggunaanminumanberalkohol di Kabupaten Batang.sehingga penulis merumuskan masalah menjadi 2:Implementasi Perda No. 12 Tahun 2013 Tentang Larangan Memproduksi Dan Mengedarkan Serta Menggunakan Minuman Beralkohol Di Kabupaten Batang, dan Kendala- kendala dalam Implementasi Perda No.12 Tahun 2013 tentang Laranganmemproduksi, mengkonsumsidanmengedarkanminumanberalkohol di KabupatenBatang.
Setelah membaca dan melihat kembali proses dalam terbentuknya Perda No.12 Tahun 2013, penulis sangat tertarik dan memutuskan untukmelakukan penelitian tentang Perda No.12 Tahun 2013 tersebut.Metode yang digunakan oleh penulis adalahjenispenelitian yang bersifatdekriptifAnalitis, karenapenelitianinibertujuanuntukmenggambarkansecarasistematisdankomprehensifmengenaiPerda No. 12 Tahun 2013 TentangLaranganMemproduksi Dan Mengedarkan Serta MenggunakanMinumanBeralkohol Di KabupatenBatang.
Dari penelitian yang penulis lakukanternyataPerda No.12 Tahun 2013 tidak berjalan semestinya karena Pemda Batang sedang disibukan dengan saling menunjuk tugas antara Satpol PP dengan Kepolisian Batang dalam pelaksanaan, karena Perda tesebut tidak menegaskan Instansi mana bertugas menegakkan dan melaksanakan Perda tersebut. Dan dalam kurungwaktu yang berdekatanPerpres No.74tahun 2013 tentangPengendaliandanpengawasanminumanberalkohol disahkan oleh Presiden, dan Perda No.12 Tahun 2013 dianggap bertentangan dengan peraturan yang lebih tinggi darinya maka proses pelaksanaan Perda tersebut di cabut dan tidak berlaku kembali hal itu sesuai dengan ketentuan Pasal 40 UU No.12 Tahun 2011 setelah Perda No.12 Tahun 2013 dicabut, kemudian satpol PP hanya menertibkan barang-barang tanpa cukai, seperti rokok dan minuman beralkohol yang dioplos.
Dari penelitian yang penulis lakukan banyak sekali yang harus di perbaiki dari sistem keamanan di daerah Kabupaten Batang yang kurang efektif apalagi di malam hari, karena ternyata masih ada beberapa orang yang mengkonsumsi minuman beralkohol ditempat umum yang minim pencahayaan, dan harapanpenulis jika Perda No.12 Tahun 2013 di perbaiki dalamaspek sistem keamanan dan menunjuk petugas pelaksanaan perda No.12 Tahun 2013 agar dapat dilaksanakan di lingkungan Kabupaten Batang

ABSTRACT

Social affairs keeps changing and developing to the tune of the dynamics of social life in society. One of social affairs that has become a problem these days is alcholism, i.e. cosuming over dose liquor, which causes losing one’s control and rule violation or criminal act. Batang residency is not different. That’s why,Batang district administration stipulates Regional Regulation No. 12 Year 2013 regulating the distribution and consumption of alcoholic beverages in Batang Regency. The writer thus formulates this problem into two categories: The implementation of Regional Regulation No. 12 year 2013 Concerning The Prohibition Of Production, Distribution, And Consumption Of Alcoholic Beverages In Batang Regency; obstacles in the implementation of regional regulation No. 12 Concerning the Prohibition of production, distribution, and consumption of alcoholic beverages in Batang Regency.
After reviewing the process of Regional Regulation No. 12 Year 2013 formation, the writer is highly interested in and thereof decides to do the research on this Regional Regulation No. 12 Year 2013. The method, in this case, the writer uses is analythic-descriptive one, because the objective of this research is to describe systematically and comrehensively the Regional Regulation No. 12 Year 2013 Concerning The Prohibition Of Production, Distribution, And Consumption Of Alcoholic Beverages in Batang Regency.
The Regional Regulation No. 12 Year 2013 researchdidn’t work as it supposed to be as the Local Government of Batang is being busy delegating the enforcement of the regulation between Civil Service Police Unit (Satpol PP) and Police of Batang, because the Regional Regulation does not asserts which institute to enforce and execute the regulation. And around the same time Presidential Regulation No. 74 Year 2013 regarding the Control and Supervision of alcoholic beverages legitimized by the President, because of which Regional Regulation No. 12 Year 2013 is considered contratry to the higher regulation. So, the process of its implementation is revoked and no longer in effect and this is in accodance to the Paragraph 40 Law No. 12 Year 2011 after the revocation of the Regional Regulation No. 12 Year 2013. The Civil Service Police Unit (Satpol PP) can then only keep without-tax stuff in order such as cigarettes and adulterated alcoholic beverages.
Out of this research the writer notices that there a big number of security system aspects that must be improved, specially the ineffective ones in the night in Regency of Batang, because there are some people consuming alcoholic beverages in low lightning public places. In addition, the writer hopes there will be some improvement in the Regional Regulation No. 12 Year 2013 on the security system aspect so that law forcers could be appointed to implement the Regional Regulation No. 12 Year 2013 in the regions of Batang Regency.
