ABSTRAK
Adanya perubahan dari desa menjadi kelurahan menuntut adanya penyesuaian
perangkat dasa menjadi perangkat kelurahan karena dalam kedua sistem
pemerintahan itu walaupun setara namun komponen-komponen yang ada dalam
birokrasinya berbeda. Di Kabupaten Pekalongan, perubahan tersebut terjadi di dua
desa, yaitu desa Ambokembang Kedungwuni dan desa Legokclile Bojong Kabupaten
Pekalongan, dimana statusnya kini telah menjadi Kelurahan. Menurut Sekretaris Desa
Ambokembang, perubahan status desa menjadi kelurahan terjadi karena bengkok desa
atau lahan dari tanah bengkok didesa Ambokembang sangat tidak produktif ,
sehingga pemasukan untuk kas desa serta biaya perangkat desa menjadi sangat kecil.
Sedangkan status tanahnya kini telah dialihkan kepemilikannya, yang semula sebagai
pemasukan desa kini statusnya telah berubah menjadi hak milik. Dimana tanah
tersebut telah dialihkan atau ditukar gulingkan dengan masyarakat setempat yang
pastinya dengan syarat-syarat tertentu yang memenuhi segala aturan Pemerintah
Daerah Kabupaten Pekalongan.
Metode yang dipergunakan dalam penelitian ini adalah pendekatan yuridis
sosiologis. Analisa yang digunakan dalam penelitian ini adalah analisa deskriptif
kualitatif.
Berdasarkan hasil penelitian dan pembahasan tentang pemindahtanganan
Tanah Bengkok di Kabupaten Pekalongan maka penulis dapat mengambil kesimpulan
sebagai berikut : Pemindahtanganan Tanah Bengkok di Desa AmboKembang
Kabupaten Pekalongan menunjukkan bahwa pemindahtangan Tanah Bengkok dengan
Tanah Hak Milik Yayasan Muhamadiyah diperuntukkan untuk kepentingan umum
yaitu Rumah Sakit. Sedangkan hasil penelitian di Desa Legokclile Kecamatan Bojong
Kabupaten Pekalongan dilakukan dengan tujuang untuk kepentingan umum yaitu
Tanah Bengkok di tukar dengan Tanah Hak Milik dengan tujuan untuk Tanah
Bengkok tersebut akan dilakukan pembangunan SD Inpres, Pembangunan Balai
Desa, Pompa Air, dan Lapangan Olah Raga. Model Kepemilikan Tanah Bengkok
yang tepat yaitu adalah bahwa tanah bengkok yang telah menjadi Hak Pakai dalam
penggunaannya dan pemungutan hasilnya merupakan tanah yang dikuasai oleh
Negara.

ABSTRACT
The change from village to village dasa requires alignment device into the
village because of the system of government that although both equal but the
components that exist in the different bureaucracies. In Pekalongan regency, changes

The method used in this study is a socio-juridical approach. Analysis used in
this research is descriptive qualitative analysis.
Based on the results of research and discussion on the alienation of land in
Pekalongan Crooked writer can draw conclusions as follows: Land Alienation in the
village of Crooked AmboKembang Pekalongan suggests that the alienation of the
Crooked Land Land Property Rights Foundation of Muhammadiyah intended for
public use ie Hospital. While the results of research in the village of Olean Legokclile
Pekalongan District to do with the public interest in exchange with the Crooked Land
Land Properties for the purpose of land development will be done Crooked
